OVERVIEW

Welcome to Sweatrope™! The terms “we”, “us” and “our” refer to Sweatrope™. Sweatrope™ operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Sweatrope™ is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”) describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully. By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

Nothing in these Terms excludes, restricts, or modifies any guarantees, warranties, rights, or remedies implied or imposed by the Australian Consumer Law (ACL), contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth), or any other applicable Australian legislation that cannot be lawfully excluded.

SECTION 2 - OUR PRODUCTS

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. However, we cannot guarantee that your computer monitor's or mobile device's display of any color will be completely accurate.

All descriptions of products or product pricing are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

Note for Australian Consumers: Product listings and descriptions carry statutory guarantees under the ACL that goods will match their description and be of acceptable quality.

SECTION 3 - ORDERS AND CANCELLATIONS

When you place an order, you are making an offer to purchase. Sweatrope™ reserves the right to accept or decline your order for any legitimate commercial reason (e.g., product out of stock, unauthorized transactions, or pricing errors). Your order is not accepted until Sweatrope™ confirms acceptance or dispatches the item.

In the event that we make a change to or cancel an order, we will attempt to notify you by contacting the email address, billing address, and/or phone number provided at the time the order was made. If your order is canceled after payment has been processed, we will issue a full refund to your original payment method.

Purchases are intended for personal or household use only and are not intended for commercial resale or unauthorized export.

SECTION 4 - PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. Prices charged for a product will be the price in effect at the time the order is placed and will be set out in your order confirmation email.

Unless otherwise expressly stated, posted prices are displayed in Australian Dollars (AUD) and are inclusive of Goods and Services Tax (GST) where applicable. Shipping, handling, or express delivery charges will be added at checkout.

You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases. You represent and warrant that:

  1. The credit card or payment information you provide is true, correct, and complete.

  2. You are duly authorized to use such payment method.

  3. Charges incurred by you will be honored by your financial institution.

SECTION 5 - SHIPPING AND DELIVERY

Delivery dates provided by Sweatrope™ are estimates only. While we aim to dispatch goods promptly, we are not liable for reasonable delivery delays caused by freight carriers, postal networks, customs processing, or events outside our reasonable control.

Risk in the goods passes to you upon delivery to your nominated address. If an item arrives damaged or is lost in transit prior to delivery, please contact us immediately in accordance with our Refund & Returns Policy.

SECTION 6 - INTELLECTUAL PROPERTY

Our Services—including but not limited to all text, graphics, logos, product images, software, trademarks, and overall site layout—are owned by or licensed to Sweatrope™ and are protected by Australian and international intellectual property laws.

These Terms permit you to use the Services for personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any material from our site without our prior written consent.

Sweatrope™ trademarks, logos, and branding may not be used in connection with any product or service that is not Sweatrope’s without express approval.

SECTION 7 - OPTIONAL AND THIRD-PARTY TOOLS

We may provide you with access to third-party tools or integrations (such as payment gateways or tracking utilities) over which we neither monitor nor have control.

You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties or conditions of any kind regarding third-party software functionality. Any use by you of optional third-party tools offered through the site is entirely at your own risk and discretion.

SECTION 8 - GOVERNING LAW & JURISDICTION

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Australia and the state/territory in which Sweatrope™ operates, without giving effect to any principles of conflicts of law.

Any disputes arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts operating in Australia.
